While not a direct declaration from Costner himself, the lawyer’s comments strongly suggest the lead actor will indeed be involved in season 5 to some degree.

However, Costner’s lawyer did seem to leave the door open for the actor to take on a reduced part in upcoming seasons. The statement merely indicates Costner is still working on the show currently.
It remains possible Costner films a limited number of episodes for the back half of season 5 before setting up an official departure later on. The star has made no secret of the strain working on the Montana-based show puts on him.
